These Terms of Service (“Agreement” or “Terms of Service”) govern your use of any website (“Site”), mobile application, and services (collectively, the “Services”) of Fundora Games (“Company,” “Fundora Games,” “we,” “us,” or “our”). By using the Site or any Services of Fundora Games, you agree to abide by these Terms of Service, as they may be amended by Fundora Games from time to time in its sole discretion. Fundora Games will post updated Terms of Service on the Site whenever these Terms are changed. If at any time you find these Terms unacceptable, you must immediately leave the Site and cease all use of the Services. If you breach these Terms, we may take action against you, including termination of your account.

Persons under 13 years old are not allowed to use the Services. Persons between 13 and 18 require the consent of their parent or legal guardian (“Parent”) to use the Services. To the extent permitted under applicable law, Fundora Games declines responsibility for activities conducted by a person under 13. If you are a Parent and provide consent for your child to use the Services, you agree to these Terms regarding your child’s use.
Fundora Games operates online mobile gaming services and mobile applications that accompany such services.
By using the Sites and Services in any way, you agree to the following:
We may terminate or suspend your access to the Services at our sole discretion, without notice, including if (a) you fail to comply with these Terms; (b) we suspect fraud, cheating, or misuse; or (c) we suspect unlawful activity.
You may purchase, with real money, limited, non-transferable, non-sublicensable, revocable virtual currencies and virtual in-game items (“Virtual Items”) and other goods or services for personal, non-commercial entertainment. You may only purchase Virtual Items from authorized partners of Fundora Games. All rights in the Services (including game content and code) are owned by or licensed to Fundora Games.
Unless explicitly authorized by Fundora Games: (i) transfers of Virtual Items to other users are prohibited; (ii) you may not buy or sell Virtual Items outside the Services; and (iii) Fundora Games does not recognize such transfers or sales. Any attempt violates these Terms and may result in termination of your rights to use Virtual Items and/or your account. All Virtual Items are forfeited if your account is terminated or suspended, or if Fundora Games discontinues the Services. YOU ACKNOWLEDGE THAT YOU HAVE NO PROPERTY RIGHTS WHATSOEVER IN VIRTUAL CURRENCY ITEMS.
All sales through the Services are final. Fees and charges (including for Virtual Items) are non-refundable, in whole or in part. You are fully liable for all charges to your account, including unauthorized charges. Fundora Games may amend pricing, availability, specifications, content, or features of products sold through the Services at any time, effective upon posting.
You are prohibited from violating or attempting to violate any security features of the Site or Services, including: accessing content or data not intended for you; probing, scanning, or testing vulnerabilities; breaching security or authentication measures; interfering with service to any user, host, or network; sending unsolicited emails; forging headers; attempting to reverse engineer or decompile any source code used by Fundora Games. Only Fundora Games or its licensees may host Fundora Games’ games or apps. Alternative user interfaces, protocol emulation, or modified clients are prohibited.
Subject to your agreement and continued compliance with these Terms and any other relevant policies, Fundora Games grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Services for personal, non-commercial entertainment. You agree not to infringe others’ intellectual property rights and not to upload or distribute infringing content.
Restrictions include (without limitation): you shall not buy/sell/rent/give away your account; you shall not create an account using a false identity or on behalf of someone else; you shall not use the Services if you have previously been removed or banned by Fundora Games. You shall not engage in conduct that conflicts with the spirit or intent of the Service; or use cheats, exploits, bots, hacks, mods, or unauthorized third-party software; or modify files that are part of the Service without express written consent.
WITHOUT LIMITING ANY OTHER REMEDIES, FUNDORA GAMES MAY LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE OR PORTIONS THEREOF if you fail to comply with these Terms or for actual or suspected illegal or improper use, with or without notice.

Fundora Games reserves the right to terminate your use of the Services and/or Site. We may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement, or unauthorized use, in accordance with our Privacy Policy.
THE SERVICE AND INFORMATION FROM OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Fundora Games disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant the Service will meet your requirements or be uninterrupted or error-free.
To the maximum extent permitted by law, Fundora Games shall not be liable for any indirect, incidental, consequential, special, punitive, or similar damages (including lost profits, data loss, or business interruption) arising out of or relating to these Terms or the Service, whether based on contract, tort, or any other legal theory, even if advised of the possibility. To the extent not prohibited by law, Fundora Games shall not be liable to you for more than the amount you paid to us for purchases made within Fundora Games’ titles.
Nothing in these Terms affects statutory consumer rights or excludes liability for gross negligence or willful misconduct.
You acknowledge you do not acquire any property rights in the Site, Services, game data, or any status within the Services. While we strive to keep game data safe, Fundora Games shall not be liable for loss of any game data for any reason. Regarding all virtual in-game currencies: YOU DO NOT ACQUIRE ANY PROPERTY OR INTELLECTUAL PROPERTY RIGHTS WHATSOEVER IN THE IN-GAME CURRENCIES.
You agree to indemnify, defend, and hold harmless Fundora Games, its affiliates, officers, directors, employees, and agents from any third-party claims, losses, liabilities, damages, and costs (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.
“Forum” means any chat area, message board, instant messaging, mobile messaging, or email function offered as part of the Services. Anything you submit via a Forum may be routed through Fundora Games’ servers and can be read or copied by others. Share personal information at your own risk. The Services and/or games of Fundora Games may allow posting user contributions. You agree not to submit content that is offensive, illegal, deceptive, or that contains viruses or spam. Fundora Games may monitor, edit, remove, or disclose such content as permitted by law and may terminate access for violations.
All website code and associated files for the Site or Services belong to Fundora Games.
Unlawful use of Company trademarks is strictly prohibited. Such trademarks include, but are not limited to: “Fundora Games”.
If a dispute arises between you and Fundora Games, we encourage you to contact us first via in-game help or at info@fundora.games. You agree that all disputes shall be governed by the laws of Turkey by a Courts and Execution Offices of Istanbul (Center), without regard to conflict of law provisions, and you submit to the jurisdiction of such court.
If any provision of these Terms is found unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
Company may, in its sole discretion and without prior notice, (a) revise these Terms of Service; (b) modify the Site and/or the Service; and (c) discontinue the Site and/or Service at any time. Company shall post any revision to these Terms of Service to the Site, and the revision shall be effective immediately on such posting. You agree to review these Terms and other online policies periodically.
